Today, the 7th Administrative Court of Appeal held an expert discussion of the provisions of the Law of Ukraine “On Administrative Procedure”.
“Our today’s meeting is significant, as we want to discuss the important question of changes to the legislation. In these difficult times for our countries, we can even better understand the importance of progressive steps in legislation, as it is a sign of a democratic state with the rule of law. At the same time, legislative changes are bringing Ukraine closer to the EU countries, where such a law has long been in effect,” stated Head of the 7th ACA Vitaliy Kuzmyshyn welcoming the attendees.
The Head of the Administrative Court of Cassation of the Supreme Court Mykhailo Smokovych also welcomed the attendees, emphasizing the relevance of the conference that would help outline the key provisions of the law and discuss the case law of this new legislation.
“The law will enter into force in 2023, and the judicial community should be ready for its enforcement. That is why our discussions must be active and all-encompassing,” noted Oksana Tsymbrivska, head of the EU’s “Law-Justice” Project.
Expert discussion covered six key areas:
place of the Law in the system of legislation, key terminology, and principles; participants of administrative proceedings and persons that facilitate trials; initiating and preparing an administrative case for trial; administrative act; international experience of enforcing the unified law on administrative procedure; potential legal collisions after the Law on Administrative Procedure takes force and ways to resolve them.
The following speakers explained the issues for the attendees:
Viktor Tymoshchuk, senior associate of the Koretskiy Institute of State and Law of the Academy of Sciences of Ukraine, expert of the EU’s “Law-Justice” Project; Andriy Shkolyk, Professor of the Administrative and Financial Law Department of the Legal Faculty of the Lviv National Ivan Franko University, and expert of the “EU4PAR” Project; Edith Zeller, a judge of the administrative court of Vienna, expert of the EU’s “Law-Justice” Project; Martin Steinkueller, judge of the German Federative Administrative Court; Olesya Radyshevska and Volodymyr Bevzenko, judges of the Administrative Court of Cassation of the Supreme Court.
The meeting was attended by the Head of the Administrative Court of Cassation of the Supreme Court Mykhailo Smokovych, judges of the court and judges of the 7th Administrative Court of Appeal.
The event was a combination of offline and online formats, with international representatives from Vienna and Germany joining via Zoom.
The event was organized by the 7th Administrative Court of Appeal in cooperation with the Administrative Court of Cassation of the Supreme Court with support of the EU’s “Law-Justice” Project.
