PGG III: Support to development of the constitutional justice in Ukraine
Project Description
The Project supports the development of the constitutional justice in Ukraine, fostering expertise and exchange of experience, as well as promotion of dialogue between the Constitutional Court of Ukraine and a constitutional court from an EU Member State, building capacities of the Court regarding the coherent interpretation of human rights standards, doctrines, and principles, based on methodologies and approaches of interpretation applied by ECtHR and ECJ.
Project implementation will involve elements of the EU twinning instrument to share best practices of constitutional justice developed in a selected EU member state. The project will ensure a close exchange of experience and knowledge, as well as dialogue opportunities for judges and staff of the Constitutional Court of Ukraine with its European counterpart both on matters related to organisational structure and working procedures relevant for the functioning of the Court, as well as specialised knowledge for better delivery of constitutional justice in Ukraine.
This project is implemented within the third Phase of the joint programme of the European Union and the Council of Europe “Partnership for Good Governance.” It builds on the results of the previous phases of the Partnership for Good Governance in the field of strengthening justice (Phase I 2015-2018 and Phase II 2019-2023).

Specific Objective
The project aims to better orient the functioning of the Constitutional Court of Ukraine toward the European models and approaches and to address better the protection of constitutional rights of Ukrainian citizens; to improve the quality of legal interpretation of the Constitutional Court, with reference to the respective European standards, including the case-law of European Court of Human Rights (ECtHR) and the European Court of Justice (ECJ); and to equip the Constitutional Court of Ukraine with the best practices of its European counterparts, with the aim to starts applying them.
Expected Results
1. Targeted capacity-building is provided to the Constitutional Court of Ukraine on the key elements of interpretation of conventional mechanisms and fundamental rights in the case-law of ECtHR and ECJ.
2. Analysis of the implementation of the ECtHR interpretation principles in the case-law of the Constitutional Court of Ukraine is undertaken.
3. Twinning activities are delivered, including an exchange of visits, workshops and thematic roundtables between the Constitutional Court of Ukraine and a constitutional court in an EU Member State.
